It sounds confusing: simultaneously implementing both track 1 and track 2. Yet, it happens regularly. The UWV requires that the employer at all times considers the opportunities for the sick employee within the company. This is a requirement in a track 1 process. When a labor expert determines that a track 2 process needs to be initiated, employers often leave the track 1 process behind. But that is not wise. Even in the second year of illness, the UWV expects the employer to look for an internal solution. On the other hand, you shouldn’t drag things out for too long and sometimes you need to make decisive choices.
This means that an employer must continuously look for opportunities for a solution within the company and the shortest route to work. That route may also lie outside the current employer. This so-called two-track policy must be thoroughly assessed and evaluated, otherwise you will definitely get questions about it during the WIA application. It requires a professional approach.
We have extensive experience with this and use the right tools to properly document this process. The UWV always wants a solid justification for why something does or does not succeed. If you have a case where a labor expert is involved, please contact us to discuss your approach.
